TERMS & CONDITIONS - TOURS
BOOKING POLICY
Accurate passenger weights must be provided at the time of booking.
Maximum passenger weight allowed is 130kg. All passengers and bags will be weighed prior to departure for safety and operational reasons. If the aircraft payload is exceeded on the day, we reserve the right to deny travel to passengers whose weight information provided at the time of booking is inaccurate by +5kgs or more, in which case no refund will be provided.
Full payment is required in order to confirm all bookings.
A valid Australian Seniors card or Pensioner card for your country of residence must be presented at time of booking to receive the Senior rate. Senior rates apply on selected tours.
Minimum passenger numbers may apply to tours.
Infants are classified as 0 to 2 years of age and may be carried free of charge on the lap of a parent. Children are defined as being from 3 to 12 years of age.
CANCELLATION POLICY
A strict cancellation (this includes rescheduling) policy applies to all tours.
Less than 48 hours’ notice prior to departure – NON REFUNDABLE
Full refund provided for any cancellations before 48 hours of tour departure time and flexible reschedule available.
Kimberley Air Tours recommend all passengers take out travel insurance.
Kimberley Air Tours reserves the right to cancel or alter any tours in the interests of safety and comfort, or due to unforeseen circumstances.
MITCHELL FALLS HIKE & HELI ADVENTURE CONDITIONS
The hike has a Class 5 rating and requires a high level of fitness. The trail is mainly in the direct sun with minimal shade. Parts of the trail involve climbing over rocks, uneven ground, and a water crossing. We allow a max of 2 hours to complete the 4km hike. A waiver form will need to be signed on the morning of the tour by all passengers prior to departing. A copy of this waiver form will be emailed to you for perusal at the time of booking. If you have concerns regarding your hiking ability our Mitchell Falls Picnic & Heli Adventure is a good alternative.
Please call our reservation staff to discuss fitness levels and walk difficulties if you have any concerns. All medical conditions which may affect the customer completing the guided walk or tour are to be advised at the time of booking.
Our pilot on the day reserves the right to deny travel to passengers who are deemed unfit to complete all aspects of this tour.
OTHER
Depending on the time of year, waterfalls may not be flowing.
An aircraft type may be substituted as required.
Island/beach location may vary due to weather conditions.
No swimming is allowed on Bungle Bungle & Lake Argyle Island Experience tour.
Flights may depart from land or water depending on operational requirements.
Dietary requirements will be catered for IF advised at time of booking.
Tour duration times are approximate and may vary due to aircraft type and additional departure points.
All scenic flights include personalised commentary by the pilot. All tours and safety briefings are conducted in English.
Prices are valid from 1st April 2025 to 31st March 2026.
TERMS & CONDITIONS - CHARTER
BOOKING POLICY
Pre-paid/cash sales customers: Full payment is required 14 days prior to departure date.
Bookings made less than 14 days, full payment is required at time of booking.
Account customers: All invoices are strictly 14 days from invoice date.
Payment can be made via Credit Card or bank transfer.
Passenger names and weights must be provided at time of booking or 48 hours prior to departure. All passengers will be weighed prior to departure. Baggage weight is to be provided at the time of booking. Bags will also be weighed prior to departure. Fabric/canvas bags are preferred to hard shells cases in the interest of space. Check-in for all flights is strictly 30 minutes before departure time. Delays caused by late check in may result in your flight being rescheduled or cancelled.
Kimberley Air Tours cannot be held responsible for missed connecting flights, it is recommended that all passengers take out travel insurance.
Individuals are responsible for obtaining all permissions (including permits from Land Councils) for complying with all laws, regulations, orders and travel requirements of the communities serviced as part of any requested charter. Kimberley Air Tours will not be liable for any failure by individuals or organisations to obtain such documents or to comply with such laws, regulations, orders, or requirements.
CANCELLATION/RESCHEDULING
A strict cancellation and rescheduling policy apply to all flights.
A cancellation or reschedule that is less than 48hrs – NON REFUNDABLE. This also applies
to Account Customers in which an invoice will still be issued.
Full refund is provided for all customers that require cancellations and flexible rescheduling before 48hrs of flight departure.
Kimberley Air Tours reserves the right to cancel, alter or amend times and prices due to tide heights and times, in the interest of safety and comfort, or due to weather or any other unforeseen circumstances.
FREIGHT
Any dangerous goods that are due to be taken on the flight must be declared at least 48hrs prior to departure and may incur a handling fee. Extra restrictions may apply. Kimberley Air Tours reserves the right to refuse carriage of goods that could cause harm or damage to passengers, pilots, or aircraft. Freight consignments will be accepted up to 48hrs before the scheduled departure. Kimberley Air Tours holds no responsibility for the loss or damage of freight. If posted freight does not arrive in time for the charter, it is the responsibility of the client to collect or forward on the freight.
PAYLOADS
Payload available may vary due to weather and fuel requirements. Where payload limits are exceeded, options will be provided for you to complete your charter which may include additional fees, charters, or other freight services. Passenger uplift numbers are dependent on the actual weights of the passengers. Please note that theses weights will be subject to actual passenger weights, freight and fuel holding requirements on the day. Where passenger numbers have been given in a quote these have been calculated according to an average passenger weight of 86kg. Whilst a payload is provided in kg all freight and baggage must fit within the physical dimensions of the aircraft baggage area. Once the aircraft baggage storage area has reached capacity then it is deemed that payload has been achieved regardless of the payload in kg quoted. The safe carriage of baggage and freight is always at the sole discretion of the pilot in command.
WAIT TIME
Kimberley Air Tours and the pilot on the day will advise the latest departure time possible to return to Kununurra. Where a pilot is required to spend time on the ground waiting for a return journey, a
comfortable rest area must be provided. Where the pilot is required to overnight away from their base, the pilot must be provided with a private room and meals. Where applicable this may be arranged and included in the quotation price. Wait time is usually included in original quotation when waiting time is requested. Unless specified in the quote (or in a contract document) all unscheduled waiting time >2 hours will incur a $120 (GST inclusive) charge per hour.
OTHER
Seaplane flights may depart or arrive on either water or land dependent on operational requirements. Kimberley Air Tours reserves the right to refuse access to aircraft by persons in accordance with various Civil Aviation Safety Authority regulations orders and requirements of the Civil Aviation Act. Kimberley Air Tours reserves the right to refuse carriage of passengers that are drunk/disorderly appear drunk/disorderly are abusive to staff members and/or if Kimberley Air Tours staff deem them unfit to travel and/or pose a risk to flight safety.
Kimberley Air Tours reserves the right to change and substitute aircraft type and registration. Kimberley Air Tours reserves the right to cross hire aircraft crew and any other staff without prior notice. Kimberley Air Tours reserves the right to postpone/cancel or redirect the flight due to weather conditions, other technical reasons, or any other factors over which Kimberley Air Tours has no control or when the safety of the passengers or the crew from the aircraft can reasonably be assessed to be in danger at the discretion of the pilot(s) or of Kimberley Air Tours personnel. Kimberley Air Tours do not assume any responsibility for costs incurred by customers due to cancellation, redirection, delays and/or changes to flight.
Kimberley Air Tours reserves the right to cancel a booking in the event that an aircraft becomes unserviceable/unavailable before/during a flight and/or if an unforeseen crew change prevents the flight from being carried out. If adequate notice is given to company/persons chartering the flight, Kimberley Air Tours do not assume any responsibility for costs incurred by customers.
On a flight that has departed on its outgoing leg but is unable to make it to its destination due to but not limited to unforeseen circumstances that were not in play at the time of
departure, Kimberley Air Tours will refund 50% of the charter cost.
Urgent changes and requests within 48 hours prior to departure must be called through to the Kimberley Air Tours office on 08 9168 2653.
